Zoning setback distances can vary based on signed waivers

Boone County Commissioners adoped a resolution July 8 that will allow zoning setback distances to vary based on signed waiver agreements between property owners.

Commissioners on Monday adopted Resolution 2024-15, which allows a reduction in the established distances between rural homes and livestock feeding operations by property owners who agree.

The agreements would only allow the setbacks to be reduced or eliminated for designated properties owned by those signing the agreements. The official waiver forms must be signed in front of a notary public and filed with the Boone County Register of Deeds.

The resolution changes the wording of Articles 12 and 13 of the Boone County Zoning Regulations in cases where conditional use permits are requested.

Valuation Protest Hearings Starting at 10 a.m. on Monday, the commissioners met as a County Board of Equalization to hold valuation protest hearings.

There are a total of 46 taxpayer valuation protests this year. The Board of Equalization held 25 hearings on Monday, and scheduled the remaining 21 hearings for next Monday, July 15.

Any hearings remaining to be held after July 15 will be scheduled for July 25.

Road Vacation Considered

Commissioners several weeks ago received a request to consider vacation of a section of 120th Avenue near the intersection of 320th Street in the southern part of Boone County.

On Monday, commissioners received a recommendation to vacate the road section from Dan Stankoski, highway superintendent. He stated the road is only used for local traffic, and the closure would not result in any property being land locked.

A public hearing on the road vacation will be scheduled.

In other business Monday, the commissioners:

• reviewed wages for the County Ambulance staff and decided to keep the same wages for the 202425 fiscal year;

• approved a motion to designate the Nebraska State Print Shop for printing of postcards regarding 2024-25 property tax hearings for entities exceeding the levy threshhold.

• accepted the resignation of Tana Dozler as Veterans Service Officer effective Aug. 16, with plans to advertise the available position;

• reviewed and tabled a proposal from iWorQ on scheduling software for road maintenance projects;

• approved the County Treasurer’s semi-annual statement;

• approved the pledged collateral reports of the County Clerk and County Treasurer;

• accepted the fiscal year-end report of the County Clerk/Register of Deeds.
